Employers’ Liability insurance is compulsory in the UK.


CNA Europe is a leading provider of Employers’ Liability Insurance in the UK, which can be underwritten either as a standalone policy or, more commonly, on a primary basis as a Combined Liability Policy in conjunction with separate Public and Products Liability sections. Additionally, it can form part of a Commercial Combined policy, covering All Risks Material Damage and Business Interruption, together with other bespoke requirements such as Computer, Money and Goods in Transit.


We can also provide excess of loss solutions, above the statutory £5,000,000, for clients who require larger limits of indemnity, in order to protect against catastrophe losses involving accumulations of employees in any one location, such as a large office block.


Furthermore, we offer solutions for clients with a small number of aviation aircrew employees.


CNA Europe is also a leading writer of Medical Professional Liability insurance globally. Our comprehensive policy provides cover for Employers’ Liability exposures emanating from a wide selection of medical professional activities .


Understanding the need for flexibility, CNA remains happy to underwrite primary and/or excess programmes, structured with CNA participating 100 per cent, lead or follow as co-insurance either direct or where regulation dictates facultatively.


We are able to offer Employers’ Liability solutions for multinational companies who have operations with employees in the UK.


The Employers’ Liability (Compulsory Insurance) Act 1969 requires that all employers must purchase a minimum level of insurance, being £5,000,000 each and every occurrence.


Unless the exposure is perceived as being very severe, we follow normal market practice of offering £10,000,000 on all of Primary business, whilst restricting Asbestosis exposure to the Statutory £5,000,000.


The cover protects the Employer against claims made by Employees for Bodily injury (including death, illness, disease and psychiatric illness) caused during the period of the insurance and arising out of and in the course of their employment, wherever that may occur.


In addition to the normal defined categories of employee, we also provide cover in respect of “any person deemed to be an Employee by a court of law in the United Kingdom”. This is a wider definition than that offered by most other insurers.


International Exposures


On European or global business (subject to restrictions imposed by local laws), we can offer “Residual or Excess Employers’ Liability“ coverage, both from our UK offices and from our network of European offices.


Normally this is added as an endorsement to the Public Liability Policy or by way of a separate section as part of a Combined General Liability policy. It provides protection for the insured in circumstances where local Social Security benefits are being recovered, in cases where gross negligence on the part of the insured is believed to have caused the injury or illness.
